Welcome to Fair Tickets. These Terms of Use ("Terms") govern your access to and use of the Fair Tickets website, mobile application, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
1. Platform Overview
Fair Tickets LLC ("Fair Tickets", "we", "us", or "our") operates a ticketing platform that facilitates the sale, purchase, and transfer of tickets for live events. We act as an intermediary between event organizers ("Creators") and attendees ("Buyers"). We do not organize or host the events listed on our platform.
2. Ticket Purchases & Resell
- Final Sales: All ticket sales are final. Refunds are only issued if an event is canceled by the Creator, in accordance with the Creator's specific refund policy.
- Secondary Marketplace (Resell): You may resell your ticket through our official, integrated marketplace. A 15% fee is charged on all resale transactions, of which 70% is remitted to the event Creator and 30% is retained by Fair Tickets for platform operations. Reselling tickets outside of the Fair Tickets platform is strictly prohibited and may result in the invalidation of the ticket without a refund.
- Anti-Scalping: The use of automated software (bots) to bypass security measures or purchase tickets in bulk is strictly prohibited. We reserve the right to cancel any orders suspected of bot activity and ban the associated accounts.
3. Payment Processing
We use Stripe, Inc. ("Stripe") as a third-party service provider for payment services (e.g., card acceptance, merchant settlement, and related services). By making a purchase or receiving a payout, you agree to be bound by Stripe's Terms of Service. We do not directly store your full credit card information on our servers.
4. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
5. Disclaimers and Limitations of Liability
Event Execution: Fair Tickets is not responsible for the execution, quality, or safety of any event. We disclaim all liability arising from your attendance at an event, including personal injury, property damage, or event cancellation.
Service Availability: The Services are provided "as is" and "as available" without any warranties of any kind, whether express or implied. We do not guarantee that the Services will be uninterrupted, secure, or error-free.
Limitation of Liability: To the maximum extent permitted by law, Fair Tickets and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
6. Indemnification
You agree to indemnify, defend, and hold harmless Fair Tickets and its officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.
7. Governing Law
These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes arising out of these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
